SECTION 5 - HOW WE RESPOND TO DO NOT TRACK SIGNALS 

Some web browsers offer a “do not track” setting indicating your preferences regarding tracking which is separate and distinct from declining cookies in your browser settings. At this time, the Website does not recognize web browser “do not track” signals. Also, if you have registered with or joined the Website, you can login to your account to change certain information and preferences. 

Please allow sufficient time for your preferences to be processed. Even if you opt-out of receiving marketing messages, we may still contact you for transactional purposes like confirming or following up on an order or service request, asking you to review a product or service you have ordered, or notifying you of product recalls. If you later opt back into getting marketing communications from us, we will remove your information from our opt-out databases.

Please include verification that you are a California resident, a current physical California address for our response, and indicate what information you are seeking.  

Verification Process: To process requests about categories of information, we require that you provide at least two (2) pieces of personal information that match the personal information we maintain about you. For requests about specific pieces of information, we require you to provide us with three (3) pieces of personal information that match the personal information we maintain about you. In addition, we will require that you provide us with a signed and notarized declaration under the penalty of perjury stating that you are the person whose records you are requesting. 

  1. Disclosure or Sale of Personal Information

We have not sold any personal information to third-parties for a business or commercial purpose in the preceding twelve (12) months. We do not knowingly collect or sell personal information of minors under eighteen (18) years of age.

Verification Process: Requests will be verified depending upon our good faith belief as to the harm this information may pose to you. For requests to delete that pose a low risk of harm, for example a deletion of your browsing history on our website, we will require that you provide at least two (2) pieces of personal information that match the personal information we maintain about you. For requests which pose a high risk of harm, for example the deletion of your customer account, we will require three (3) pieces of personal information that match the personal information we maintain about you. Additionally, we will require that you provide a signed and notarized declaration under the penalty of perjury stating you are the person whose records you seek to delete.

  1. Right to Opt-Out of the Sale of Personal Information

We do not provide a mechanism for opting-out of the sale of your personal information because do not, and will not, sell the personal information we collect.  If we decide to sell personal information in the future, we will provide notice of your right to opt-out of this privacy policy. 

  1. Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

We will not discriminate against you because you have exercised any of your consumer’s rights, including, but not limited to: (a) denying you goods or services; (b) charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; (c) providing a different level or quality of goods or services to you; and/or (d) suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

You may designate an authorized agent to make a request under the California Consumer Protection Act by providing the authorized agent written permission to do so or when you have provided the authorized agent power of attorney pursuant to Probate Code sections 4000 to 4465.  We will require the authorized agent to submit proof that they have been authorized by you to act on their behalf, and except in cases where you have provided the authorized agent power of attorney, we may require that you verify your identity with us.

We do not currently offer financial incentives or price or service differences online to consumers in exchange for the retention and/or sale of their information.

  1. Exceptions 

We may aggregate and/or de-identify your information so that the information no longer relates to you individually. Our use and disclosure of such aggregated or de-identified information is not subject to this Privacy Policy and may be disclosed to others without limitation.

SPECIAL RIGHTS FOR EUROPEAN RESIDENTS

If you reside in the European Union, you may have additional rights as set forth under the GDPR. The GDPR is a complex regulatory scheme and we have not provided an exhaustive summary in this Policy. If the legal basis for our processing your personal data is your consent, the necessity to comply with your requests, or for the performance of a contract we have with you, we are automatically processing your personal data; although you have the right to receive a copy of such personal data in a structured, commonly used format. However, this right does not apply where it would adversely affect the rights and freedoms of others.

To the extent that the legal basis for our processing of your personal information is consensual, you have the right to withdraw that consent at any time subject to applicable exceptions. Withdrawal will not affect the lawfulness of processing before the withdrawal. 

If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work, or the place of the alleged infringement.

Privacy Shield & Data Protection Authorities: We believe that we are, or as of the relevant time will be, in compliance with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Data transferred from the European Union to the United States. We commit to comply with the applicable Privacy Shield Principles for all onward transfers of Personal Data from the EU, including its applicable onward transfer liability provisions. We have, or as of the relevant time will have, certified to the Department of Commerce that we materially comply with the principles of the Privacy Shield and in the event of any conflict as between this Privacy Policy and the Privacy Shield, the Principles of the Privacy Shield will control.
